Terms of Service

These Terms of Use ("Terms") govern your use of the Hey Fennec mobile application ("the App"), developed by Metin Demirel ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
In addition to these Terms, Apple's Standard End User License Agreement (EULA) applies to your use of the App: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use on Apple devices you own or control, in accordance with the Apple EULA and these Terms.
2. Nature of the App — not a medical service
Hey Fennec is an entertainment and attention-practice game. It is not a medical device and does not provide medical, psychological, or clinical diagnosis, assessment, treatment, or advice. Any references to focus, attention, or training describe gameplay and practice only. If you have health concerns, consult a qualified professional.
3. Your data
The App stores your data only on your device and, if you enable iCloud, in your private iCloud account. We do not collect or store your data. See our Privacy Policy for details.
4. Subscriptions (Hey Fennec Premium)
The App offers an optional auto-renewable subscription, Hey Fennec Premium, which unlocks premium features (such as the Zen and Time Attack modes, the full attention report, and premium background packs):
- Options: a monthly plan and an annual plan.
- Free trial: a 7-day free trial may be offered to new subscribers. If you do not cancel before the trial ends, it automatically converts to a paid subscription.
- Billing: payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal: the subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Managing and canceling: you can manage or cancel at any time in your Apple account settings: Settings ▸ [your name] ▸ Subscriptions. Cancellation takes effect at the end of the current billing period; you keep Premium until then.
- Prices are shown in the App before purchase and may vary by region. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds are handled by Apple in accordance with Apple's policies (reportaproblem.apple.com). We cannot issue App Store refunds directly.
5. Acceptable use
You agree not to reverse engineer, modify, redistribute, or misuse the App except as permitted by law.
6. Intellectual property
The App, its code, artwork (including the Hey Fennec character and icon), and content are owned by us and protected by law. These Terms do not transfer any ownership to you.
7. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
9. Apple
Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Any App maintenance, support, and warranty claims are our responsibility, not Apple's, as described in the Apple EULA.
10. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules.
11. Changes
We may update these Terms. Continued use of the App after changes means you accept the updated Terms.
